The probate process may be confusing, but at its core it is really just taking the assets of a deceased person and distributing the inheritance as determined in the estate plan.
Although the deceased person may have a will, the courts must decide if it is valid.
They also must make sure all of the deceased person's debts and taxes are paid.
It is important to note that even if you die intestate, or without a will, your estate will still go through the probate process, and a judge will appoint a personal representative in the place of an executor.
At Elizabeth A. Richards Attorney at Law, we offer sound advice and legal representation to individuals, beneficiaries, executors and administrators in all forms of estate planning and probate procedures.
Since the topic of probate is a rather unfamiliar area of law for a lot of individuals, we have provided a Probate FAQ page.
We encourage you to continue reading the list of commonly asked questions that we have included below.
If you are in need of further information, don't hesitate to contact an Oklahoma City probate attorney directly from our firm to schedule a free consultation.
We work with you individually to ensure your estate plan perfectly aligns with your goals.
Estate planning is the process by which individuals make arrangements for the disposal of their estate.
Estate planning is thus closely related to elder law.
Estate planning can involve several complex issues such as probate, taxes, wills, trusts, beneficiary designations, powers of appointment, property ownership, powers of attorney and so forth.
Many individuals do not realize the importance of setting into place an estate plan or the benefits associated with hiring an estate planning attorney.
