I routinely handle divorce, custody, support, property division, and domestic violence cases, often in the context of a military divorce. I have twenty-seven years of experience and am licensed in both Virginia and North Carolina. While for ten years I represented women only in divorce and custody, my practice now represents men as well.

In North Carolina, Judges look to the best interest of the minor child in establishing custody.
The code gives little direct guidance as to what specific factors a court must consider.
The court must, in cases of domestic violence, consider the safety of the child and the victim of domestic violence.
In my experience, judges will review each parent's relationship with the child and history of caring for the child, the child's relationships with siblings and other family members, how parents have behaved towards each other during the separation in allowing or prohibiting contact between the child and the other parent, each parent's character (including but not limited to criminal history, mental health issues, and substance abuse), and each parent's ability to encourage and support the child's education.
Virginia Judges consider many factors in determining spousal support, either on a temporary basis while the divorce is pending or for "permanent" support.
Support generally stops upon the death of either party, the remarriage of the recipient, or the recipient living in a relationship like a marriage for a period of one year or more.
Adultery, even after separation, can bar a person from receiving spousal support.
For this reason, I often tell my clients that "you can go out to dinner, but you can't go home for dessert."
Courts must first identify property as separate, marital, or hybrid.
Separate property is property acquired prior to marriage, through an inheritance, or as a gift from someone other than a spouse.
Spouses generally have no interest in the separate property of the other spouse, as long as it has been segregated and maintains its separate identity.
Marital property is any property acquired from date of marriage until date of last separation, regardless of title.
Hybrid property is property which is part separate and part marital.
Like most trial attorneys, I enjoy litigation and the strategy of the courtroom.
Most of my clients, however, do not enjoy litigation.
It can tear apart families and create wounds that take years to heal, if they ever do.
Parents who formerly loved and respected the other parent are forced to bring out every nitpicking fault, in an attempt to gain an advantage in trial.
For these reasons, I often will recommend alternative dispute resolution ("ADR") for my clients, where domestic violence is not an issue.
