Mediation can have two meanings in a family law proceeding, and if so each will affect your case in a different way.
The first meaning refers to an alternative dispute resolution (ADR) process, where both you and your spouse meet with a single attorney who serves as a mediator.
The mediator's job is to assist both parties in reaching a mutual agreement on all issues.
The mediator cannot provide legal advice for either party and cannot draft the paperwork you will need once you have an agreement.
It is not unusual to take on a case, and then as it evolves, discover that the issues are more complex than you feel competent to handle.
In those situations, the rules of professional content - as well as your malpractice carrier - require that you so inform your client and address the issue.
I am attorney Diane Kaer, with more than 35 years of family law experience in California and more recently in Minnesota, I can help.
Whether you prefer to associate counsel for the complex issue or make a referral of the case, I am here to help and will respect your position and relationship with your client.
Child support is established using a mathematical formula created by the Minnesota Legislature.
The formula is computerized; various numbers are plugged into the program, and a number is determined that considers all of the relevant factors.
This issue is largely factual in nature, and the amount paid or received is established by a set formula.
I am founder and family law attorney Diane Kaer of Kaer Law, P.C.
For over 35 years, I have helped parents understand their rights and responsibilities when it comes to Minnesota child support, including enforcement and modification.
