Burk Law Firm, P.C
Burk Law Firm, P.C. as a business and commercial trial firm takes a minimalist approach to discovery and cost management in lawsuits.

Whether the Firm handles the case on an hourly fee basis, a hybrid basis (substantially reduced hourly with a back end percentage interest with credit for fees paid, etc.), a full contingent fee arrangement, or on a flat fee basis, our approach is to do only the discovery that is critical to preparing the case for trial which is also the best way to place the case in the best posture for pretrial settlement.

While we make every effort to enlist the Court's help in curbing such discovery abuse, in Court's where the judges are elected and where their campaigns are funded by the attorneys who practice before them, the Court is not always willing to curb such discovery abuse and therefore the Firm's minimalist approach may not be as successful.

Fortunately, most courts will stop such discovery abuse and therefore in most cases the Firm's minimalist approach to discovery works extremely well for the client and for the efficient, fast and successful outcome of the case.

Fiduciary duty refers to the legal duty that each member of a certain type of business or professional relationship has to act in the best interests of the other member and never advantage himself over the other to whom he/she oversees a fiduciary duty.
Therefore, the fiduciary is forbidden to act in any way that is beneficial to the fiduciary and detrimental to the principal's interests.
Unfortunately, sometimes a fiduciary fails to uphold his or her duties, either for personal gain or to favor another party's interests.
If you are involved in a complex business dispute, it is of the utmost importance that you have a qualified, complex business litigation firm that specializes in complex litigation to represent your interests.
Unfortunately, many attorneys who are not competent to handle complex business cases undertake them because they involve large fees and then improperly handle them after billing the client for hundreds of thousands of dollars without gathering the necessary evidence, not gathering in a usable form, and without having pursued a strategy to posture the case in a way that makes a successful outcome more likely.
When you enter into an energy contract with an oil, gas, or alternative energy provider, you expect the other party to abide by the terms and conditions of your legal agreement.
Unfortunately, sometimes energy companies fail to adhere to the terms of their contracts, and smaller organizations and individuals may feel powerless to take legal action against large corporations with considerable power and influence.
Worse, after the fact you may learn the other contracting party committed fraud to induce you to enter into the contract to continue it.
Federal agencies such as the Environmental Protection Agency and other federal, state, and local organizations are tasked with regulating the negative environmental impact that corporations, other business entities, factories, and individual enterprises may have.
Unfortunately, some companies and person only have their own financial interests in mind and do not consider the well-being of the surrounding community or neighboring businesses, and they may work hard to dodge environmental laws and avoid taking responsibility for their toxic waste and other dangerous pollutants.
Executive contracts are intended to protect the rights and interests of both a company and its executive(s).
Unfortunately, if both parties' needs are not met, these contracts can ignite fiery disputes between the two.
Generally, business executives do not sign the same contract as other workers because they are afforded more benefits and greater compensation for their occupation.
Failure to pay salary, bonuses, commission, or other forms of compensation owed to the executive.
The appropriate amount of compensation in the event that the company is sold, broken up, or merged with another business or partnership.
