It is a specter children and adults fear alike.
And if divorce happens to you, you will be catapulted into one of the most stressful, surprisingly emotional and overwhelming experiences of your life.
Let's be honest.
Feelings of pain and betrayal run rampant in a divorce, and people don't typically make the smartest decisions under that kind of duress.
And that's a problem: A poorly managed divorce where you make emotional decisions and unknowingly fail to protect your rights can lead to devastating effects on you and your family, particularly if you have underaged children.
The question of child custody can be one of the most heated and frustrating aspects of a divorce.
Texas courts will be guided by "the best interests of the child".
And once a custody and visitation order is in place, it typically stays in place.
THAT's why "getting it right" from the start is critical.
It will affect the relationship you have with your children for the duration of their minor years and possibly beyond.
Will you want sole custody?
Joint custody?
Grandparental rights?
What about visitation and holidays and vacations and school breaks?
All parents, married or not, must support their children financially.
However, support varies from one family to another and not all agreements are created equal.
So you strongly benefit from good legal counsel in these matters, which will impact your financial situation for years to come.
In cases where parents share joint custody, no child support is required.
But a parent who makes significantly less than the other parent may still qualify for support from the higher-income parent, even though the parents equally share custody.
CPS Matters are where Family and Criminal law are most likely to intersect, and Jarvis & Kelly are proud that their double-specialty is particularly effective in these tough cases.
Child Protective Services (CPS) was created to protect children from unhealthy and downright abominable situations.
But we've also seen the dark side of CPS: Removing kids from good homes, not notifying other family members, placing kids in questionable homes, ruining reputations and relationships, and creating a financial burden for parents suddenly faced with a court battle against CPS.
An SAPCR is a type of court case that can be filed by either a parent or an authorized person to request child custody, visitation, child support and medical support.
It's filed under a variety of situations.
It can be part of a divorce or pursued by separating parents who were never married.
Significantly, this legal remedy is also available to guardians, conservators, or relatives who find themselves caring for a child.
You have had actual care, control and possession of the child for at least 6 months (and are not a foster parent).
