Montgomery County District Attorney
Daryl Bailey is the District Attorney and the Chief Law Enforcement Officer for the Fifteenth Judicial Circuit. The Montgomery County District Attorney's Office is committed to providing the best service possible to the citizens of our County. Our dedicated and diverse staff prides itself on seeking justice for all victims. We believe in addressing underlying issues that cause the majority of individuals to commit crimes, including but not limited to, lack of an education, lack of job skills and illegal substance abuse.

This approach also means punishing with the purpose of making sure low-level offenders become law-abiding citizens. Our Pre-Trial Diversion, Drug Court and Helping Montgomery Families Initiative programs help individuals become productive members of society. Being "smart on crime" means we can lower the crime and recidivism rates, and in doing so protect the citizens of Montgomery County.

Services
The Montgomery County District Attorney's Child Support Unit was formed in 1980 to act as the legal counsel for the Montgomery County Department of Human Resources in court actions for paternity establishment and child support orders.
The unit is made up of a director, two deputy district attorneys, and support staff.
The two attorneys represent the State of Alabama and provide legal counsel for about 500 cases each month.
About 400 new referrals are received monthly from the Department of Human Resources.
The Grand Jury is a historic institution and serves an important role in our society.
It is sometimes referred to as the "watchdog" of the community.
The Court is responsible for appointing 18 Montgomery County citizens to the Grand Jury each term.
The Montgomery County Grand Jury generally meets for one week every month.
Special sessions and additional Grand Juries can be scheduled as needed.
Its duty is to receive complaints and accusations in criminal cases, hear the evidence presented on the part of the State of Alabama, and determine if there is probable cause for an indictment or formal legal charge.
The Restitution Unit was formed in 1986 for the purpose of monitoring, tracking, and collecting restitution on criminal cases.
A Restitution officer is responsible for monitoring and tracking all court ordered payments made by the defendant.
The Restitution Officer enforces the court's order with several different methods: restitution dockets, contempt hearings, restitution agreements, income withholding, and prison account attachments.
The restitution process begins at the time of Grand Jury.
As a victim, you will be asked to complete a restitution affidavit which lists your losses, including travel, missed work, property, medical, and other expenses resulting from the crime.
The Victim Services Unit of the District Attorney's Office provides victims with support before, during, and after their cases are being processed through the judicial system.
The unit provides information, forms, and affidavits that make it possible for victims to seek restitution.
This unit is the voice for victims in the judicial system.
A priority of this unit is to provide personal assistance to individuals who are victims of crime.

The Montgomery County District Attorney's Worthless Check Unit was formed in 1985 to collect restitution for victims of worthless checks.
The unit assists businesses and individuals who receive insufficient funds and account closed checks.
The Worthless Check Unit is a self-funded service of the District Attorney's Office.
There is no charge to victims to use our service.
When the bad check writer fails to pay through our office, we assist with the prosecution.
If you are a victim of a worthless check, and you want the assistance of the District Attorney's Office, certain guidelines must be followed for a warrant to be issued.
