Through the Chapter 7 bankruptcy process, credit card debts, personal loans, medical bills, deficiency claims on repossessed vehicles, tuition and other types of debts are discharged.
A Chapter 7 debtor is permitted to get a "fresh financial start" and a chance to start again.
It is true that the bankruptcy laws were overhauled in 2005, making it harder for some people to file, but most people are still eligible.
Chapter 12 of the Bankruptcy Laws (11 U.S.C. §1201, et sec.) is designed to assist individuals and families whose income primarily results from farming and fishing.
It is similar to Chapter 13 in that a plan is prepared by the debtor and presented to the Bankruptcy Court for confirmation, but it differs from Chapter 13 in that it affords benefits to farmers and fishermen unique to their financial situation.
Chapter 12 was added to the Bankruptcy Code by Congress by the Bankruptcy Judges, United States Trustees, and Family Farmer Bankruptcy Act of 1986.
